Bacon Furious With Attorneys

Hedge fund billionaire Louis Bacon can't make sense of the way how a court matter turned out in the magistrate's court in the Bahamas last week.  He cannot fathom how his attorney made a clear escape from prosecution, while a huge loophole exists that now leaves him as a fugitive, according to the attorneys who filed the criminal prosecution.

Attorneys Keod Smith and Alfred Sears has expected Bacon to come to court in light of the summons against him.  He was to be served along with his attorney, Pericles Maillis, Lyford Cay Properties Managing Director Mary Braithwaite, disgraced former police officer Bradley Pratt, private investigator Jerry Forrester, and executives of the Canadian Broadcasting Corporation for allegedly conspiring together to spread lies about Peter Nygard.  

The Attorney General's office stepped in and asked Magistrate Janine Weech-Gomez to accept their nolle prosequi, which essentially stopped the case.  It was a rare move that left critics wondering why the Attorney General John Delaney would take such a drastic step to protect an investor.  But AG Delaney made a big mistake when he signed the order drafted by his office, because the order left out the name of the main defendant, Louis Bacon.

With Maillis also listed as a defendant, reports are that Bacon is raging mad that Maillis, who was present for the hearing, did not ensure that his name was also included in the nolle prosequi.  The error of the AG office will be the advantage of the Nygard legal team, according to attorneys Smith and Sears.  Smith said Monday that he has knowledge that Bacon is in the Bahamas and is sticking close to his FNM buddies with the General Elections just days away.  For this reason, Smith claims that FNM leaders are essentially harboring a fugitive by helping him evade a "legitimate court process".

Bacon is being called upon to defend himself against accusations that he is the mastermind behind the erroneous documentary aired on the Canadian Broadcasting Corporation, that painted Mr. Nygard as a tyrant and one who attempt to evade laws in the Bahamas such as immigration restrictions.  The documentary, called "Larger Than Life"aired in Canada and was seen throughout the world.  

Nygard's attorneys have proof that compelled them to seek justice through the courts.  They have witnesses who are willing to testify that the information they gave the CBC came about because officer Pratt and Mr. Forrester paid them thousands of dollars to defame Mr. Nygard.  

In the Canada Courts, Nygard has won round one of the defamation and libel suit against the CBC.  His attorneys in the north will be looking at the Lennan case, in which the CBC aired a false documentary on two doctors.  The doctors won a suit of over a million dollars in damages.

FNM Leaders Harboring Fugitive, says Attorney

With just days to go before the General Elections in the Bahamas, the Prime Minister and some of his Cabinet Members are being accused of helping a foreign investor evade prosecution.  Their attempts were so desperate to protect this investor, it was claimed, that a major mistake was made that will pave the way for the complainant to get an audience before the court.

Senior Attorney Pericles Mailis faced the courts just days ago surrounding this case.  He was accused of conspiring with others to use libel to defame the character of Peter Nygard.   Attorneys Keod Smith and Alfred Sears brought a criminal prosecution case last week against Mailis and others, accusing them of fulfilling the wishes of Louis Bacon in his scheme to defame and disgrace his Lyford Cay neighbor, Peter Nygard.  Mailis, along with a private investigator, a police officer, Lyford Cay manager, and executives of the Canadian Broadcasting Corporation were to face a criminal suit with Bacon as the main defendant. 

The Attorney General's office intercepted the procedure before Magistrate Janine Weech-Gomez and entered a nolle prosequi to cause the case to be dropped.  But the Attorney General made a serious error when he signed the nolle prosequi without ensuring that the main person he was trying to protect was listed on the document.  By failing to make sure that Louis Bacon was to be covered by the annulment, AG Delaney has opened the way for Bacon's alleged deceitful tactics to be exposed.   

Bacon is a known friend of the governing Free National Movement, and its Cabinet members have covered up for him in the past.  When Bacon dug up the shoreline to make a home for his new mega-yacht, Minister of Environment Earl Deveaux allowed his officers to issue Bacon a permit even though he had broken the law.  This was admitted by the Leader of Government Business in the Senate Dion Foulkes while speaking from the Upper House.

Then Bacon broke the law again when he brought in super sonic sound speakers known as Long Range Acoustic Devices which are used by the military to control very large crowds, leaving many to wonder how such dangerous equipment could have come into the country in the first place.  When word got out that such dangerous weapons were in the possession of a foreign resident, police held a raid at Bacon's Point House and seized them.  Bacon's lawyer admitted to the media that his client did use the powerful speaker weapons on Nygard, his employees and guests.  Minister of National Security Tommy Turnquest told the public a different story, leading many critics to point out that a series of cover-ups for Bacon were occurring.  Turnquest said the concern was that the LRADs were affecting the signals that air traffic controllers relay to incoming flights.  Strangely enough, the speakers were returned to Bacon.  The public responded with a series of calls into local talk shows, stating that there was an obvious double standard being set here, and that it was a dangerous one considering the escalating crime rate.

This time, the biggest cover up is being effected by the country's chief of law, the Attorney General, who sought to stop a case against Bacon, even though there was enough evidence based on international cases already in progress, for the case to be heard before a judge.  Critics say it doesn't help that Delaney is also a Lyford Cay resident.

Attorney Smith said that due to the fact that Bacon was left out of the nolle prosequi, he is now considered a fugitive of the courts until such time as he is either brought before the courts, or the AG's office seeks to correct the mistake at which time a representative of Bacon must still appear.  

Smith believes Bacon is in the Bahamas and is evading the summons which ought to be served on him in light of the recent developments of the case.

"We consider Bacon to be a fugitive of the law attempting to avoid service of a legitimate court process that he is fully aware of; and certain government officials are also aware of this,"said Smith.  "The Attorney General, Earl Deveaux, Tommy Turnquest  and even the Prime Minister are all aware of his whereabouts and are essentially harboring a fugitive."


Bacon has been relentless in his attempt to destroy his neighbor, and Nygard claims it all started when he refused an offer for the purchase of his beloved Nygard Cay.  Since then, his home suffered a massive fire, and government officials have refused to grant him a permit that, in this case, should have been granted a long time ago, for his home to be renovated.

Government officials seem not to care about Nygard's proposition for the rebuilding of his home, which would employ over 300 Bahamians over a three year period.  It seems more important to them to ensure that Bacon, whom sources point to as one of the financiers of the FNM 2012 election campaign, stays out of trouble even though he is the one apparently stirring it up.

He got his attorney Mailis into hot water by having him hire Jerry Forrester, private investigator, and disgraced police officer Bradley Pratt, to extort Nygard and also pay over $10,000 for former employees of Nygard to come forward and speak ill of Nygard on Canadian national television.  Mary Brathwaite, Managing Director of the Lyford Cay Property Owners Association is tied up in the case as she failed to step in much earlier in this war between neighbors when Bacon built an entire easement over a portion of Nygard's property, which significantly changed the face of the entrance to Nygard Cay.  The easement, which is the subject of a case in the Supreme Court between Nygard and Bacon, also causes a serious flooding problem at Nygard Cay every time it rains.

In Canada, judges have already given Nygard the nod to proceed with a defamation and libel case against Canadian Broadcasting Corporation executives for airing a documentary called "Larger that Life"on their Fifth Estate programme knowing that there were falsehoods being propagated against a well known Canadian fashion designer whose activities have been beneficial to Canada, his birth home, and the Bahamas, his beloved home and retreat, which inspires most of his outstanding fashion designs.  

Bacon is also under international surveillance as one of his employees at Moore Capital Investments is listed on a criminal rap sheet centered a round a multi-billion dollar international scam.

Criminal Case Against Bacon to Proceed

The Attorney General of the Bahamas made a major legal mistake in executing a nolle prose qui in the Magistrate's Court this week when he left out the main defendant in a high profile battle in the courts between two foreign residents. Peter Nygard, known internationally as a fashion designer but much more well known to Bahamians as an avid supporter of sporting groups in the Bahamas, had his attorney file a criminal suit as a part on an international libel and defamation case. The criminal suit listed hedge fund czar Louis Bacon as the main defendant, along with his attorney Pericles Mailis; Managing Director of the Lyford Cay Property Owners Association Mary Braithwaite; private investigator Jerry Forrester; former police officer of disrepute Bradley Pratt; and executives of the Canadian Broadcasting Corporation.

 The suit brought by Nygard accuses them of using criminal tactics to concoct a defamatory exposé on him which aired on the CBC. The exposé portrayed Nygard as a dictatorial boss who dodged immigration laws to have a beautiful, young, Dominican girl brought to his quarters at Nygard Cay. Nygard claims the video, which aired on CBC's "The Fifth Estate", was just one part of a major plan of attack that his neighbor, Louis Bacon set upon him with after Nygard refused an offer to sell his beloved Nygard Cay. The case has its roots in Nygard's native country, Canada, where Supreme Court Judges have already given Nygard's attorneys the nod to proceed with their libel and defamation case against the CBC. Attorneys will be relying on the Leenan case, in which two doctors won just over a million dollar suit for libel and defamation after CBC aired a similar negative exposé on them, which affected their careers drastically.

 While Judges in the north have validated the case which is now proceeding, the Government of the Bahamas pulled out all of the stops to stop it from proceeding here. Nygard's attorneys Keod Smith and Alfred Sears took the case go the Chief Magistrate's Court on Thursday. Representatives of the Attorney General's office were in court to stop those proceedings, petitioning the court to throw out the case. But Attorney General John Delaney missed a very critical procedure. His office left off the name of the main defendant, Louis Bacon. Nygard's lawyers are expected to take advantage of that and use the nation's chief legal representative's mistake as an opportunity to advance their cause.
 Why would judges in Canada see the merit of the case and allow it to proceed; while in the Bahamas, the government stepped in so that the cause could not be advanced? Could it be because The government was desperate to please one of their best financiers with just two weeks left before the General Elections? Why would the government seek to halt such a case when Nygard's attorneys brought facts from the case proceeding in Canada which shows reason for a criminal case to at least have the audience of a court of justice?

 Attorney Smith spoke to reporters after the hour long court session which was filled with debates from both sides. He told them that the case against Bacon will continue despite the success of the annulment against the other defendants. "What was demonstrated here makes me very concerned that the Attorney General in his Executive capacity, is allowing himself as a sword for Mr. Bacon and the persons on the charge sheet," he said. "it is record time that a nolle was issued in the proceedings and as you would have seen yourself in the court today, the attempt was being made to block any possibility of this matter even being called up, let alone continued," he told reporters.

 Attorney General Delaney claimed that the nolle was entered because his office tries not to have personal matters coming before the criminal courts. He also claims that the matter in its entirety was "discontinued" but he may be may be in for a surprise when he finds the error that Attorneys Smith and Sears have. The case has good merit in that witnesses are ready to come to court to let the Bahamian people know that they were paid for discrediting Nygard. We are told that they were offered $10,000 and even more if they found another interviewee. Further evidence includes proof that the private investigator was working for Bacon and he was recruiting the staged witnesses along with Pratt.

FASHION MOGUL SEEKS CHINESE PARTNER FOR MAJOR OPPORTUNITY


Peter Nygard has vivid memories of when he first came to Shanghai in the early 1980s to set up a women’s clothing factory.  Back then, he had one of the only cars in the city.  Now, after more than 30 years of manufacturing in Tianjin and Shanghai, he plans to bring his retail business Nygard International, wildly successful in North America, to the Chinese mainland.  “China is not just a part of my success, it is the part of my success,”he said.  
A household name in North America, with headquarters in Winnipeg, Canada, and a flagship store in New York’s Time Square, it sells its clothes each year under 10 different brands, yet is relatively unknown in China.  By next year, however, this is likely to change.  Nygard wants to launch on the mainland within the next two years, part of a plan to open 20 stores across Asia and the Middle East.  First though, he needs a Chinese retail partner with whom he can do business.  
“Whoever’s out there and wants to make a fortune, just talk to me,” he says.  
The child of Finnish immigrants who moved to Canada and set up home in a converted coal shed, Nygard has built a retail empire from an $8,000 investment.  While fashion designers compete ferociously for the attention of the young, the slim, the fashionable, Nygard caters to what he calls a “forgotten group” - women over 25, average dress size US 14, who want comfort as well as style.  
“My job is to make women look slimmer,”he says.  The brand is adored by its loyal customers for its value and fit. 
Nygard attributes his success to a combination of creativity and hard work.  He typically clocks 14 hour days, seven days a week.  “I’m busier now than I’ve ever been in my life,” he says.  
After decades in the apparel business, Nygard has a new focus: biotechnology.  Three years ago, prompted by a desire to regain the fitness levels of his athletic youth, he began researching stem cells and realized the potential for developing anti-aging treatments. With the help of Chinese academics in the field, he has already opened a clinic in Macau.    
“What can be more important than your health?  It’s the ultimate product,” he says.  

 

Bacon, Police Officer, and CBC Executives Face Criminal Case in Bahamas


A new criminal complaint has been filed in the Bahamas courts against a police officer, a hedge fund billionaire, A Lyford Cay resident, and media professionals in the latest phase of an international fight for Peter Nygard to clear his name.

Nygard has already won the first round in the courts in Canada against the Canadian Broadcasting Corporation, claiming that the media giant went beyond the scope of true journalism to wreck his image and career, all for the sake of his Lyford Cay neighbor, Louis Bacon.  Judges in Canada saw good reason to allow Nygard’s case to proceed.  The fact that the CBC did a similar smear campaign against two doctors doesn’t help their case this time around.  Dr. Frans Leenan, a well known cardiovascular researcher, and Dr. Martin Myers, brought a libel suit against CBC in 2002 and won after the court ruled that the documentary aired on the doctors was “sensational journalism of the worst sort”, giving a multi-million dollar damage award to the doctors. 

Nygard’s fight extended from Canada to New York and now to the Bahamas, as residents here were also allegedly caught up in the plot.  The criminal suit filed in the Supreme Court is set against Louis Bacon; Jerry Forrester; Bradley Pratt; Timothy Sawa; Morris Karp; Bob McKeown; Pericles Maillis; and Mary Braithwaite.

Bacon, Forrester and Pratt are already facing a case in the Supreme Court: Action 00393/2011, in which a veteran officer of London’s Scotland Yard Police swore an Affidavit describing and alleging a pattern of conduct of which Bacon led the ground work for a smear campaign against Nygard.  Former Scotland Yard Inspector Mr. Alick Morrison of 7 Castleham Court Middlesex London gave the court information about a worrisome conspiracy hatched by Bacon.  

The nasty debacle is said to have stemmed from an argument over property. Nygard contends that his complaints to the Lyford Cay Property Owners Association went unanswered as Bacon continued with the construction of an extension to his property that directly interfered with Nygard’s property.   To date, Nygard and his guests fear when it rains, as Bacon’s construction has caused a deluge at the entrance to Nygard Cay.  Also his guests have been severely cut off from the original entrance and new guests get lost trying to find Nygard Cay and the neighbors construction has totally changed the layout of the entrance.   

Inspector Morrison alleged that Bacon got the Lyford Cay Property Owners Association to work with him to discredit Nygard in a way which would lead to his expulsion from the community. The Association, led by Managing Director Mary Braithwaite,  is alleged to have hired Forrester to do the dirty work. Forrester, a private PI, then hired Pratt to help him.  The Scotland Yard officer describes Pratt in the Affidavit as a cold calculating man who killed or maimed prisoners on his keep.  Forrester talks extensively on secret video tape recordings about Pratt killed a prisoner that Forrester literally kidnapped and brought back to Nassau.  Forrester also brags about his running interference to get the Canadian television station to air the documentary in an attempt to bring Nygard down. 

CBC employees who allegedly participated in the plot are also facing the criminal suit of defamatory libel.  The defamatory libel pertains to statements made by Allan and Michelle May, former Nygard employees, and comments made by the host creating the impression that Nygard assaulted a guest from the Dominican Republic while she was at Nygard Cay.  She fully denied this under oath.
CBC hired questionable representatives that are alleged to have acted inappropriately  they had an opportunity to talk to her before broadcasting the story but were instructed not to do so by the CBC employees who are the defendants in this criminal case, namely: Timothy Sawa, producer/director; Morris Karp, co-producer; and Bob McKeown.  Summons have been issued.         

These CBC representatives allegedly hired Forrester and Pratt and worked in collaboration with Bacon's Lawyer Pericles Mailis as well as Mary Braithwaite to find people who would give fabricated statements on camera.  Court statements will show allegations that Bacon was prepared to pay women up to $10,000 to give false statements about Nygard’s alleged actions. 

The Media, being the fifth estate, is held to a standard which CBC allegedly neglected for the sake of a ransom that Bacon put out.  The media house is alleged to have continued to pay Forrester and Pratt for information even while knowing that such criminal scheme was being conducted, all with the use of Canadian taxpayers' money.  The purpose of the conspiracy was to extort prime real estate known as Nygard Cay from Peter Nygard.

Pratt alone is charged separately on two other counts of extortion. CBC Fifth Estate producers knew that Forrester was a Bacon security consultant in Bahamas and were in touch with Steve Davis, a former New York police officer working for Bacon as his chief of "special" security. The witness statements confirm that the Bacon "special" agents were continually feeding information to CBC for broadcast purposes.

Bacon's Bahamian lawyer, Pericles Maillis, and PI Forrester, have been charged with criminal conspiracy in relation to finding persons to falsely state that they were indecently assaulted by Nygard.

Witness statements have been obtained which confirm that many people were approached by Pratt, his cousin Princess Pratt and others to make up false stories about Nygard to harm his reputation. People were said to have been offered sums of up to $10,000 for false information & additionally, another $10,000 if they were prepared to grant an on camera interview with 'CBC - Fifth Estate'. They were also offered money to find others to make such false allegations.  

Another criminal charge has been laid against Bacon and Braithwaite pertaining to Nygard’s easement rights over Bacon’s property which is the only land access to Nygard Cay. The count relates to the defrauding by Bacon and Braithwaite of Nygard’s property rights. Statements elaborate at length on the unscrupulous steps taken by Bacon and his agents to deprive Nygard of his easement which would cut off land access and virtually destroy all the value of Nygard Cay -- thus giving control of the property to Bacon, which Nygard claims has always been Bacon’s ultimate goal. The primary conspiracy by Bacon and Braithwaite, the court statements say, was that Bacon would purchase the property of his easterly neighbor and over a four-year period, completely limit roadway access to Nygard Cay, while destroying Nygard's legal easement access.  Each time Nygard sought help in getting Bacon to stop his attack on his property access, he claimed Bacon would employ the LCPOA and Police to stop Nygard from defending his rights to his own land.

After Bacon’s propositions were denied, a mysterious fire seriously damaged an extensive portion of Nygard Cay, where rich architectural designs inspired by a Mayan Temple inspired international photographers.  To date, Nygard has been unable to get government approval to rebuild his home, employing 300 Bahamians and spending nearly 20 million in the process. 

It is alleged that Bacon  has a close association with the present governing party, the FNM, which questionably has been refusing to grant Nygard building and zoning permits to rebuild his world famous home.  He hasn’t received proper assistance from government in obtaining immigration visas for his employees, amongst other things.   Court documents also state that Bacon has allegedly attempted to obtain other property in the Bahamas inappropriately.  In addition, Bacon has apparent ties with American presidential hopeful Mitt Romney by offering to hold a fund raiser for his bid to gain the presidents chair in America.  He left a half a million dollar donation with his friend Romney.  He offered the same amount to the Torries in the UK.  However, the Bahamas has no law forcing political parties to disclose their funders and it is for this reason Bahamians can only hold a strong assumption that he has done the same for the FNM.

Fashion designer files new defamation lawsuit against CBC
A new lawsuit claims the CBC took the word of convicted con artists willing to unfairly accuse Peter Nygard of acting inappropriately with a woman, even though she swore his innocence.
The defamation case, filed Tuesday, is the latest in a long line of civil and even criminal suits brought forward by the fashion designer against the CBC in the wake of an unflattering Fifth Estate documentary about him that aired in April 2010. The suit also names Fifth Estate host Bob McKeown, as well as CBC employees David Studer, Morris Karp and Timothy Sawa.
According to the statement of claim, Nygard says the state broadcaster defamed him by implying he engaged “in inappropriate conduct with a woman, a woman who is a citizen of the Dominican Republic.”
According to the suit, the CBC were provided a notarized statement a day before the documentary aired from the woman, who stated nothing untoward happened when she visited Nygard Cay. Nygard’s then-girlfriend has also stated the fashion designer was with her in his private cabana every night the supposed victim was at the resort, as was his personal bodyguard.
The documentary noted none of those things when it aired the next day. Instead, it included a segment where McKeown referred to the woman as a “special package” brought to Nygard Cay in 2003 to help celebrate the fashion designer’s birthday. Soon after, convicted con artists Allan and Michelle May, two former Nygard employees, made statements on air which Nygard claims were false.
“The words ... are untrue and defamatory of Nygard in their natural and ordinary meaning, in the innuendoes contained therein, and in the context of the entire Fifth Estate program, including the manner, tone and presentation,” the lawsuit states.
“They were meant and were understood to mean that Nygard had lured the woman to his residence under false pretences, Nygard had acted inappropriately toward the woman, Nygard had sexually assaulted the woman and Nygard had committed a criminal act.”
Months after the documentary aired, Nyard’s private investigator, a former Scotland Yard detective, gave a sworn statement claiming he had been told CBC investigators had found the woman in the Dominican Republic prior to the documentary’s broadcast, but did not attempt to interview her.
Nygard is seeking damages.
A spokesman for the CBC, Chuck Thompson, declined comment.
None of the allegations have been proven in court.

FNM & BACON RELATIONSHIP ON THE ROPES

All of the financial concerns of the Free National Movement are reportedly vanishing now that the “Plane Land” and the Money bags are full and ready for distribution. Thanks to the deep pockets of the Chinese, Louis Bacon and the Aga Khan; the FNM is poised to flood the streets and voters pockets with cash.


Could this be the reason why Ingraham confidently proclaimed that he will win the “Over the Hill” seats after he makes an appearance in the area next week.



With this reported injection of cash, Ingraham "The One Band" is in a must win situation if he is to please his financial backers, who are counting on a FNM Victory at the polls.
With the general elections just a matter of weeks away Bahamas National understands that most of the expected campaign funds for the upcoming election recently arrived secretly in the country through Andros. We also understand that it is a sizeable amount believed to be some $30 Million dollars. These funds are supposedly set to hit the streets this week in effort to secure a FNM win in the over the hill and depressed areas around the island. 
It’s because of dismal performances of Environment Minister Earl Deveaux, National Security Minister Tommy Turnquest and Minister of Foreign Affairs Brent Symonette we understand that Prime Minister Hubert Ingraham decided cut Ministers Deveaux and Symonette from his team because of the perception that both men's image and hands according to members of the public and media were to dirty.
       


Such perception of the FNM Cabinet Ministers especially for Earl Deveaux began when the permission was granted for mega-billionaire Louis Bacon to dredge for his marina in Lyford Cay after he had already done so. This was admitted by the government from the floor of the Senate.
   
It is alleged that Bacon made a large donation to the FNM during the 2007 campaign and has done the same again in 2012. Bacon is no stranger to contributing to political parties and organizations. Recently, Bacon has openly made generous donations to the Republicans in the U.S. and the Torries in the UK - countries where campaign finance disclosure is mandatory.
Then there was the permission granted by Environment Minister Earl Deveaux and the Ingraham FNM government and Bahamas National Trust giving permission to the Aga Khan for the dredging of the National Marine Park in the Exuma cays where millions of dollars were said to have been dispersed among the parties concerned.
But it all appear to come to a head about a year ago when popular talk show host Steve Mckinney began exposing the men while on the Gems 105.9FM radio station owned by then Debbie Bartlette and Cyprianna Mcweeney.
   
Because of the skillful manner in which Mckinney linked the Bell Island, Lyford Cay Point House, Kamalame Cay, Andros incidents together and that of the alleged rock mining by the Brent Symonette family that has been heralded by Pierre Dupuch a former FNM Cabinet Minister in the Hubert Ingraham government.
It is alleged that Ministers Earl Deveaux, Tommy Turnquest and Brent Symonette plotted with Debbie Bartlette to get Steve McKinney’s and his show "Hard Copy" off of her Gems radio station. This happened at a time when the radio station was in a financial crisis, falling months behind on payroll and other bills.
It is also alleged that Deveaux, Pereclise Mailis and other ministers pressed Ms. Bartlett to boot Mr. Mckinney off the radio station for which it is believed that she was handsomely paid to do.
Imagine, then, just how much the principals of the rich, famous and special interest groups must be paying the FNM government to ensure that they stay in power, and continue to support the ulterior motives of those with the cash to pull the hood over the eyes of those who care more about their own future than the future of the Bahamas.
It is also being said that the tarnished FNM government leaders are very scared that if they do not help their major financier Bacon in overcoming his questionable dealings in the Bahamas that the police is seeking questions about the FNM could lose his financial support and face possible defeat at the polls.
A major factor for the FNM is to help Bacon with is overcoming legal challenges in The Bahamas especially against his Lyford Cay neighbor Peter Nygard.
For the past several years the staff at Nygard Cay has reported to the police, many alleged illegal actions taken by Louis Bacon and his staff ranging from reports of trespassing to the alleged  planting of bugs and listening devices on Nygard’s property and vehicles.
   
Another issue was Bacon’s alleged use of illegal Ultra-Sonic speakers on Mr. Nygard and his guest that was seized by the police. Bacon’s lawyer Mr. Pereclise Mailis himself admitted to the use of the dangerous weapons on Nygard and his staff and friends. Police have yet to give a full report on their investigations into this matter.

Sources indicate that Bacon is afraid that if the FNM loses the government he would not be able to complete the objective of stealing Nygards land at Nygard Cay that is presently before the courts and if the Ingraham FNM party loses the government he would have to face the Bahamian courts on all of the matters relating to him and Peter Nygard which he (BACON) is afraid of losing.
According to what is being reported in the Bahamian media there is a good possibility that Bacon will lose his legal battle with Nygard because Nygards legal team has a very good case against Bacon.

It is being said that Louis Bacon is so afraid of losing his legal battle against Nygard in that it is alleged that Bacon is now calling on the Ingraham government to utilize the Attorney General’s office and that of the Chief Justice and other senior magistrates to put a rush on his court case and rule in his favor against Nygard.
It is also believe to have been said that if Bacon does not win his legal battles against Nygard he will cut off the FNM government and promise never to return to the Bahamas. This despite the fact that Bacon has already fled the Bahamas and put his Point House home in Lyford Cay up for sale.

   
Then there is also the Canadian Broadcasting Corporation case where they aired a negative expose on Nygard in an effort to discredit him despite his philanthropic efforts in Canada and the Bahamas. Mr. Nygard’s two former employees Allan and Michelle Mays who are both now fugitives on the run in the Eastern Caribbean countries are all mentioned with Louis Bacon in court dockets in Canada allegedly conspiring together to use the facility of the media to bring down the Canadian fashion mogul Peter Nygard.
And again just recently the billionaire hedge fund manager Louis Bacon had found himself in yet another questionable situation, this time with possible legal repercussions. His name was called in a major fraud action filed in the United States District court, in the southern district of New York. As chief of Moore Capital Management, he faces accusations of violating antitrust and racketing laws.
All of of these legal battle and major fraud cases in the Bahamas and the United States has the hedge fund king on the run and such actions have put the Ingraham FNM party in a financial bind in that such a great financial backer for their elections in the past could be in great jeopardy maybe because this time Prime Minister Hubert Ingraham, Earl Deveaux,Tommy Turnquest and entire government cannot fix a bad situation that has now run its cause over the period of years in the Bahamas where just maybe, justice will be served on both Louis Bacon in his long run with the law and the Ingraham FNM government in the 2012 general elections.

Fire Falling On The FNM This Election

Too much heat can consume anything, even the source of such heat; and as the date for the 2012 General Elections in the Bahamas is set for May 7, Prime Minister Hubert Ingraham will have to face the fire and it remains to be seen whether his government will be consumed and hence expelled this year.
                                                     
The Free National Movement first came to power in 1992 and maintained a mantra of trust and transparency - key words that they expected would continue to bring them victory at the polls.  Bahamians haven't hesitated to show PM Hubert Ingraham who is boss in the past.   He was put to shame  when he brought a Referendum to the Bahamian people.  A multiple referendum with five questions was held on February 27, 2002. Voters were asked whether they approved of the removal of gender discrimination from the constitutionthe creation of a national commission to monitor the standards of teachers; the creation of an independent parliamentary commissioner; the creation of an independent election boundaries commission; and the increase of the retirement ages of judges from 60 to 65 (or 68 to 72 for appellate judges).  All five questions were rejected by voters, with between 62.8 and 70.9% voting against.


Pundits predict that the same fate awaits PM Ingraham and his party; the campaign machine intends to pull out all the stops and possibly use drastic measures to try to pull of another election victory.  His only hope is that the party's investors may still have a bit of confidence and dig deeply to fund whatever the measures may be.  


By all means, certain special interest groups have been benefitting in such quiet ways from the FNM governance that the average voter is unaware that billions of dollars have been swooped away right from under their noses.  Had it not been for veteran media personalities with keen understanding and background about Bahamian political history, the average voter would have been oblivious to the amount of wealth being amassed unbeknownst to them.  
   



                         
Steve McKinney and Pierre Dupuch put their thinking caps on after certain "red"flags were raised during the FNMs latest term in power.  Dupuch questioned the processes that were utilized for all of the developments that took place under the FNM.  He wondered where all of the fill that was excavated during this term disappeared to.  He educated Bahamians on the value of our limestone rock.  Through a series of vastly distributed emails, he explained how asphalt and pharmaceutical companies pay big bucks for the precious limestone which is perfect for making medical pills as well as for forming asphalt roads.  Mr. Dupuch pointed to the billions of dollars that could be garnered from such a trade, and his sources gave him reason to believe that such trades are, indeed, occurring.  Considering Mr. Dupuch's assertions and the vast amount of developmental projects undertaken, there is reason to suspect that the FNM Cabinet will be sitting well whether they win the election or not.  


Environment Minister Earl Deveaux has reportedly already moved into his mansion near Lyford Cay, where many of his private friends reside.  The average Bahamian is not aware of just how close friends Deveaux and other Cabinet members really are to such mega rich residents in the Bahamas.  If they did,   it may explain certain questionable actions that the FNM continues to do its best to sweep under the rug.  Thanks to Steve McKinney's investigative journalistic style while hosting his Hard Copy talk show, there are enough clues to draw a conclusion that the FNM Cabinet is really far from transparent and cannot be trusted to protect the interests of the average Bahamian.







Minister Deveaux has been caught with his pants down with his special interest friends on more than one occasion.  His friendship with Louis Bacon was exposed when he bent the law to grant Bacon a permit through improper procedures.  The public called for his resignation after learning that he had such a close relationship with another investor, Aga Khan IV.  McKinney broke the story that Deveaux was flying around in luxury in the mega rich investors yacht while an application for him to dredge his private island was still pending before him.  The public never knew of the application for dredging until local environmentalists and the group STEP complained when they saw the beautiful hill on Bell Island being cut down.  


A look into these two relationships which the public perceived as inappropriate gives a small glimpse into a larger view of what is really going on.  A shrewd and cunning Prime Minister would ensure that relationships with mega rich investors are beneficial to himself and his cohorts; and there is every reason to believe that this PM would have done so.

 FNM Out of Time & Money
With the general elections just a matter of weeks away, it appears more so now than ever before, that the Ingraham FNM government is a bit on edge and in great fear of losing the 2012 general elections because most of the expected funds appears to have been cut off because pressure and poor public perception of the Ingraham administration.  This includes the dismal performances of Environment Minister Earl Deveaux, National Security Minister Tommy Turnquest and Minister of Foreign Affairs Brent Symonette.  Their lack of transparency has been obvious to the public and has proven to be too much of an overbearing challenge for Prime Minister Ingraham going into this general election.  The pressure for Ingraham is so great that he had to cut Ministers Deveaux and Symonette from his team because of the perception that both men, according to public perception, have dirty image.   

Such perception of the FNM Cabinet Ministers, especially for Earl Deveaux, began when the permission was granted for mega-billionaire Louis Bacon to dredge for his marina in Lyford Cay even though he had already dredged into the coast without permission. The leader of Government Business in the Senate Dion Foukes admitted to this error from the floor of the Senate. Rumors are that he is one of the mega-rich investors that threw large hands into the election donation pot for the FNM.  Bacon has openly made generous donations to the Republicans in the US and the Torries party in the UK - countries where campaign finance disclosure is mandatory. 
Minister Deveaux committed the same public offense by granting a second permit for the dredging of a marina after an investor failed to adhere to the environmental laws of the Bahamas.  Environmentalists cried out when they saw the pristine Bell Island in the national park, a protected zone, being excavated to make way for a 200 foot mega yacht that the Aga Khan wanted to have at Bell Island.  It was not until there were open protests that a press release was issued from Deveaux’s Ministry to say that the Aga Khan was given permission to dredge for the yacht.  At that time a significant portion of the hill at the island located in the national park had already been cut down to prepare for excavation of the sea bed.  Many critics questioned the timing of a million dollar donation made by the Aga Khan to the National Trust, and its inability to join the protest against the dredging of Bell Island with other environmentalists even though it is perceived as a body mandated to safeguard the Bahamian environment. 

This all came to a head about a year ago when popular talk show host Steve Mckinney began an expose while on the Gems 105.9FM radio station owned by then Debbie Bartlette and Cyprianna Mcweeney.  Because of the skillful manner in which Mckinney linked the Bell Island, Lyford Cay Point House, and the Kamalame Cay, Andros incidents together along with that of the alleged rock mining by the Brent Symonette family, the public picked up on the trend of shady and questionable behavior by some members of the Cabinet.   People also paid attention to veteran publisher Pierre Dupuch who openly declared that certain government ministers were involved in the sale of billions of dollars worth of fill from the precious Bahamian limestone rock to companies such as pharmaceutical manufacturers. 
As the public began putting these clues together, and more and more listeners tuned in to hear what else Mr. McKinney uncovered, it is alleged that Ministers Earl Deveaux,Tommy Turnquest and Brent Symonette pressured Debbie Bartlett to stop Mckinney’s show "Hard Copy" from airing.  This happened at a time when the radio station was in a financial crises where it owed  staff and was months behind on payroll and other bills.  A large payout may have solved the woes of Gems radio station as it axed its most popular host.
